Grant of Probate
Where a deceased person left a valid will and appointed executors who are able and willing to act, the executors may apply to the appropriate Probate Registry for a Grant of Probate.

Resealing of Foreign and Interstate Grants
A grant issued outside a jurisdiction does not necessarily authorise dealings with assets situated there. Where permitted by applicable legislation, a qualifying grant may be resealed by the relevant Nigerian High Court. Otherwise, a fresh Nigerian grant or another procedure may be required.

Many estates in Anambra State are affected by customary law. The applicable rules may depend on the deceased person’s personal law, form of marriage, family structure, nature of the property and whether it was acquired personally or belongs to the wider family.
The Supreme Court decisions in Ukeje v Ukeje and Anekwe v Nweke affirm that customary practices which exclude female children or widows from inheritance merely because of their gender are inconsistent with the Constitution.

What is the difference between probate and Letters of Administration?
A Grant of Probate is ordinarily issued to executors appointed under a valid will. Letters of Administration are ordinarily issued where there is no valid will. Where there is a will but no executor able or willing to act, the appropriate grant may be Letters of Administration with Will annexed.
Does being next of kin give me the right to inherit everything?
No. Being identified as next of kin does not automatically make you the sole beneficiary or give you authority to administer the estate. Entitlement depends on the will, where one exists, and the applicable succession law.
Can a family member sell a deceased person’s land before obtaining a grant?
A family relationship or next-of-kin designation does not, by itself, give authority to sell estate property. The position may also depend on whether the land belonged personally to the deceased or is family property. Obtain legal advice before dealing with it.
Can daughters inherit under Igbo customary law?
A daughter cannot constitutionally be excluded from inheritance merely because she is female. Entitlement to particular property must still be determined according to the estate, nature of the property and applicable law.
How long does it take to obtain Letters of Administration in Anambra?
There is no fixed period. Timing depends on the Probate Registry, completeness of documents, publication and assessment requirements, nature of the estate and whether an objection arises.
Can a foreign grant of probate be used directly in Nigeria?
Not necessarily. A qualifying grant may need to be resealed by the appropriate Nigerian High Court. Where resealing is unavailable, a fresh Nigerian grant or another procedure may be required.
Can an executor or administrator be removed?
A court may intervene where sufficient grounds exist concerning the conduct, capacity or suitability of a personal representative. The procedure depends on the grant, evidence and stage of administration.
What can I do if an administrator refuses to account?
A beneficiary or other person with a sufficient legal interest may seek information, accounts and appropriate legal relief. The available procedure depends on the estate, grant and conduct complained of.
