Jurisdiction Comes First

Can You File for Divorce in Nigeria While Living Abroad?

In appropriate circumstances, yes.

For a statutory marriage, the key question is whether the Nigerian court has jurisdiction. Under the Matrimonial Causes Act, that depends primarily on domicile. Living abroad does not automatically prevent you from filing in Nigeria. Nigerian citizenship alone is not enough, however, so the facts must be examined.

We confirm jurisdiction before recommending litigation. For a fuller explanation, read our guide on how to divorce in Nigeria while living abroad.

A customary marriage follows a different route. See our guide on customary marriage dissolution.

Before filing, we review

  • where you and your spouse presently live
  • your continuing connection with Nigeria
  • the type of marriage and where it was celebrated
  • whether proceedings already exist elsewhere
  • whether children or property are involved

Remote Representation

Do You Have to Return to Nigeria?

Not necessarily.

You can instruct us remotely, send documents electronically and attend consultations by telephone or video. We prepare and file the court processes, attend court and keep you informed while you remain abroad.

Whether you will eventually need to participate personally depends on the court and the evidence required. Where the court permits, virtual participation may be sought.

When the Facts Are Not Simple

Complicated Situations We Handle

Your spouse refuses to cooperate

Refusal to sign or participate does not automatically stop a divorce. Read can I divorce without my spouse's consent in Nigeria?

Your spouse also lives abroad

Proceedings may still be possible, but jurisdiction and service must be planned carefully from the beginning.

You married outside Nigeria

The place of celebration does not by itself determine whether a Nigerian court can dissolve the marriage.

You have already divorced abroad

You may not need a second divorce. The issue may instead be the recognition and legal effect of the foreign decree in Nigeria.

Children are involved

Custody, access and maintenance should be considered from the outset. See our child custody service.

Nigerian property is involved

Property issues should be identified early. Read our guide on property division after divorce in Nigeria.

A Clear Process

How Our Diaspora Divorce Process Works

Consultation

We discuss the marriage, separation, jurisdiction, children, property and your objectives by video or telephone.

Legal Assessment

We determine whether the Nigerian court has jurisdiction and identify the appropriate legal route.

Document Review

We review your marriage certificate, identification, addresses and relevant court or property documents.

Filing and Service

Once formally retained, we prepare and file the required processes and arrange service on the respondent.

Court Representation

We conduct the proceedings and keep you informed of material developments.

Final Decree

We take the matter through decree nisi and decree absolute and obtain certified court documents. Read decree nisi and decree absolute in Nigeria.

Frequently Asked Questions

Questions About Instructing Us From Abroad

Can you represent me without my being in Nigeria?

Yes. Consultation, instructions, filing and court representation can proceed while you remain abroad. Any personal participation later required will depend on the court and the evidence.

How will you communicate with me?

By video call, telephone, email and WhatsApp. We report material developments in your case.

How do I send my documents?

Electronically in the first instance. We will tell you if an original or certified copy is later required.

What happens after the consultation?

If you decide to instruct us, we send our terms of engagement and the professional fee for your matter, then begin work once the engagement requirements are completed.

How is the professional fee determined?

It depends on the complexity of the case, whether it is defended, service requirements and whether custody, maintenance or property issues are involved.

Can custody and maintenance be addressed with the divorce?

Where appropriate, child-related relief and maintenance issues can be addressed within the matrimonial proceedings.
